Terms of Service
Last updated: October 21, 2026
Sharefetti hasn't launched yet. Today this website is a coming-soon page. These Terms describe the Sharefetti service as it will work once it opens, and we'll update them before launch.
These Terms of Service ("Terms") are an agreement between you and Sharefetti ("Sharefetti", "we", "us", "our"), based in Ontario, Canada. They govern your use of the Sharefetti website, guest pages, slideshow, apps and related services (together, the "Service").
By creating an account, creating an event, uploading anything, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Key definitions
- Host: the person or organization that creates an event, including co-hosts and moderators they invite.
- Guest: anyone who visits an event page, uploads content, leaves a guestbook message, or views the gallery or slideshow, with or without an account.
- Content: photos, videos, audio, voice and video messages, written messages, names, captions, cover images, logos and anything else uploaded to or created through the Service.
- Event: an event page and gallery created by a Host.
2. Who can use Sharefetti
- Hosts must be at least 18 years old (or the age of majority where they live) and able to form a binding contract.
- Guests under the age of majority may only use the Service with the permission and supervision of a parent or guardian.
- If you use the Service on behalf of a business, you confirm you're authorized to accept these Terms for it, and "you" includes that business.
3. Your account
You're responsible for your account, for keeping your password and sign-in methods secure, and for everything that happens under your account and your events, including actions taken by co-hosts and moderators you invite. Tell us right away at hello@sharefetti.com if you think your account has been compromised.
4. The Service
- Sharefetti lets Hosts collect photos, videos and messages from Guests through a link or QR code, show them in a gallery and on a slideshow, and download them.
- We may change, add or remove features at any time. We'll try to give reasonable notice of changes that materially reduce what a paid plan includes.
- The free preview lets you set up and test an event with limited uploads. Paid plans and their limits are described on our Pricing page at the time you buy.
5. Your Content and who owns it
You keep ownership of your Content. We don't claim ownership of anything you upload.
License to us. To run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, resize, convert (for example HEIC to JPEG), display and distribute your Content only as needed to operate, provide, secure and improve the Service. This licence ends when your Content is deleted from our systems, except for copies in backups, which are overwritten on their normal cycle, and copies others have already downloaded.
License between Guests and Hosts. When a Guest uploads Content to an event, the Guest grants the Host of that event (and anyone the Host shares the event with) a non-exclusive, perpetual, royalty-free licence to view, download, keep, print and share that Content for personal, non-commercial purposes. Hosts that are businesses (for example planners or venues) may use Guest Content only as the Guest and the event owner have agreed.
We will not sell your Content, or use it in our advertising or marketing, without your separate, explicit permission.
6. You are responsible for your Content
You are solely responsible for the Content you upload and for the events you create. By uploading Content, you confirm that:
- you own it or have every right, licence and permission needed to upload it and grant the licences above;
- you have the consent of every identifiable person in it (and of a parent or guardian for any minor) to be photographed, recorded, uploaded and shared through the Service; and
- it doesn't break any law or anyone else's rights, including copyright, privacy, publicity and data-protection rights.
Hosts are responsible for telling their Guests how the event's photos will be shared (for example, on a public slideshow) and for the settings they choose, such as passwords, approval and download permissions.
We do not pre-screen, review or approve Content and we have no obligation to monitor it. Moderation tools are provided to Hosts for their convenience; we don't guarantee they will catch or stop any particular Content. We may, but are not required to, remove any Content or disable any event at our discretion.
7. Acceptable use
You agree not to use the Service to upload, share or do anything that:
- is illegal, or promotes illegal activity;
- shows the sexual exploitation or abuse of a child, in any form (we report this to the authorities);
- is sexually explicit content of any person who hasn't consented, or any intimate image shared without consent;
- harasses, threatens, defames, or invades the privacy of anyone;
- infringes copyright, trademarks or other rights;
- contains malware, or tries to break, overload, scrape, reverse-engineer or get unauthorized access to the Service or other people's events;
- uses the Service as general file storage or hosting unrelated to an event; or
- impersonates anyone or misleads people about who you are.
8. Storage, backups and deletion: please read
- Sharefetti is not a backup or archival service. Download and keep your own copies of anything that matters to you. We strongly recommend downloading your full gallery soon after your event.
- How long galleries are kept. Each event's gallery is kept for the period included in its plan, counted from the event date: Free 7 days, Gathering 15 days, Celebration 3 months, Business 6 months (or as shown on our Pricing page at the time you buy). You can buy extra time for paid plans, but no gallery is kept for more than 6 months after the event date, whatever plan or add-ons you buy.
- When a gallery closes. We'll email the Host before the gallery closes. When it closes, guests can no longer view it. For 14 days after closing, the Host may restore it for the restore fee shown on our Pricing page, up to the 6-month maximum. After those 14 days, Content is permanently deleted and cannot be recovered.
- Even during your plan, Content can be lost, corrupted, delayed or fail to upload, for example because of a guest's phone or connection, venue Wi-Fi, file format, a third-party outage or a technical fault. We don't guarantee that any upload will succeed, that any particular photo or video will be stored, or that stored Content will never be lost or damaged.
- If you or a co-host delete Content or an event, it may not be possible to restore it.
9. Sharing is in your hands
Anyone with an event's link or QR code can see the event unless you add a password, and even then anyone who has the password can see it. Guests and viewers may download, screenshot, record or re-share Content (including from a slideshow in a public space). Once Content has been viewed or downloaded by others, we can't control or recall those copies, and we aren't responsible for what other people do with them. Passwords, approval and privacy settings reduce risk but don't make an event secret.
10. Payments, upgrades and refunds
- Prices are shown on our Pricing page and are charged once per event unless stated otherwise. Customers in Canada are charged in Canadian dollars and customers in the United States (and elsewhere) in US dollars. Prices exclude applicable taxes (such as GST/HST/PST in Canada or state and local sales tax in the US), which we add at checkout.
- Payments are processed by our payment provider, Stripe. We don't store your full card details.
- You may upgrade at any time and pay the difference.
- Print files. QR card designs and print-ready PDFs are provided free for you to print yourself. We aren't responsible for printing results, including colour, size or scanning problems caused by printing, so test-scan a proof before printing in quantity.
- Add-ons (extra time, gallery restores, extra guests and video montages) are charged when you buy them and are non-refundable once delivered or applied, except where the law requires a refund.
- Business Membership is billed in advance, monthly or yearly, and renews automatically until you cancel. You can cancel at any time in your account; cancellation takes effect at the end of the current billing period, and we don't give partial refunds for unused time except where the law requires. "Unlimited events" is subject to fair use: an event must be a genuine, separate event, and we may contact you if usage is far above normal. We'll give at least 30 days' notice of any price change, which takes effect at your next renewal.
- Refunds. Our refund policy, including any money-back guarantee, is shown on our Pricing page at the time you buy. Otherwise payments are non-refundable except where the law requires a refund.
11. Third-party services
The Service relies on third parties (for example cloud hosting, content delivery, email, payment processing, Google sign-in and map or font providers). Their services are governed by their own terms, and we aren't responsible for their acts, omissions or availability.
12. Copyright and takedown requests
If you believe Content on the Service infringes your copyright or violates your privacy, email legal@sharefetti.com with: your contact details; the event link and a description or link of the Content; the basis of your complaint; and a statement that the information is accurate. We comply with Canada's notice-and-notice regime and, for users in the United States, the takedown process under the Digital Millennium Copyright Act. We may remove Content and suspend repeat infringers.
13. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your account or any event, or remove Content, if you break these Terms, if required by law, or to protect the Service, other users or the public. Sections 5 (licences already granted to Hosts), 6, 8, 9, 14, 15, 16 and 17 survive termination.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or that the Service will be uninterrupted, timely, secure or error-free.
We don't guarantee that the Service, the slideshow or uploads will be available or work at any particular time, including during your event. We recommend having a backup plan (for example, a shared album or asking a few guests to keep their originals).
We aren't responsible for Content uploaded by Hosts or Guests, for anyone's use of it, or for the conduct of any user, online or at an event.
15. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any loss, corruption, deletion, failure to upload, disclosure, misuse or unauthorized access to any Content, however caused, including by our negligence, by other users, or by third-party providers;
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, memories, goodwill, profits, revenue or business opportunities, or for emotional distress, even if we were told they were possible; and
- our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the event the claim relates to in the 12 months before the claim, and (b) CAD $100.
Some places don't allow certain exclusions or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for fraud, gross negligence or wilful misconduct where applicable, or your rights under consumer protection laws that cannot be waived.
16. Your indemnity
You agree to defend, indemnify and hold harmless Sharefetti and its directors, employees and contractors from any claims, damages, losses and costs (including reasonable legal fees) arising from your Content, your events, your use of the Service, your breach of these Terms, or your violation of any law or anyone's rights, including any claim by a person who appears in Content you uploaded or allowed to be uploaded to your event.
17. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the courts located in Toronto, Ontario, except where consumer protection law gives you the right to bring a claim where you live. If you live in the United States, nothing in these Terms limits any rights you have under the consumer protection laws of your state that cannot be waived by contract. Before starting any formal claim, please contact us at hello@sharefetti.com so we can try to resolve it informally.
18. Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll notify Hosts by email or in the app at least 14 days before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.
19. General
These Terms, with our Privacy Policy and any plan terms shown at purchase, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Where the law requires it, a French-language version of these Terms is available on request.
